Child Support and Spousal Maintenance

Child Support 

After separation your household income will vary significantly as you and your former partner set up your own homes.  It is therefore important to ensure that you are receiving the child support that is required to be paid.  While this should be a straightforward process, the child support scheme can come with complications and confusion.

Divorce

A Divorce is the formal and legal dissolution of your marriage. 

Divorce is dealt with as a separate application to the Court, and you must wait until you have been separated from your partner for 1 year before you can apply.  If you have children under the age of 18 years, you will need to attend the Divorce Hearing.

Binding Financial Agreements

If you are seeking to minimise the risk of disagreement about your financial matters in the future, we recommend you consider a Binding Financial Agreement (otherwise known as a pre-nuptial agreement, prenup or BFA) to protect your existing assets.   

While it is not a very romantic consideration, it is important to protect your assets from being eroded at the end of relationships so that you can ensure you have the resources to support yourself and your family into the future.  

You can enter into a Binding Financial Agreement prior to starting a de facto relationship, when you are engaged to be married, while you are in a de facto relationship, while you are married or after the end of your relationship.  

There are strict rules to be followed when preparing a Binding Financial Agreement and it is essential you receive specialised, competent advice from a skilled and experienced family law practitioner before entering into a financial agreement.
